By accessing or using the Capalux school timetable generation service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all users of the Service, including school administrators, educators, and any other individuals who access or use the platform.

2. Description of Service

Capalux provides an automated school timetable generation platform that enables schools to create optimized schedules based on teacher availability, room constraints, subject requirements, and other scheduling parameters. The Service includes:

  • Automated timetable generation and optimization.
  • Constraint management (teacher availability, room assignments, subject distribution).
  • Support for single and double-shift scheduling.
  • Timetable export in various formats (PDF, Excel, etc.).
  • Real-time schedule adjustments and manual overrides.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities that occur under your account.
  • Notifying us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or contain inaccurate information.

4. Subscription Plans and Pricing

4.1 Free Tier (Basic)

The Basic plan is offered free of charge and includes limited features as described on our pricing page. Capalux reserves the right to modify the scope of the free plan at any time.

4.2 Paid Plans

Paid subscription plans (Pro, Enterprise) are billed on a monthly basis. Prices are listed on our website and are subject to change with 30 days' prior notice. All fees are non-refundable unless otherwise stated.

4.3 Payment

Payment is processed through third-party payment providers. By subscribing to a paid plan, you authorize us to charge the applicable fees to your chosen payment method. Failure to pay may result in suspension or termination of your account.

5. User Data and Content

5.1 Your Data

You retain all ownership rights to the data you input into the Service, including teacher lists, subject lists, room information, and generated timetables. You grant Capalux a limited license to use this data solely to provide and improve the Service.

5.2 Data Accuracy

You are responsible for the accuracy and completeness of the data you provide. Capalux is not liable for scheduling issues arising from incorrect or incomplete input data.

5.3 Data Backup

While we implement reasonable backup measures, you are encouraged to maintain your own copies of important data. Capalux is not liable for data loss due to unforeseen circumstances.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Attempt to gain unauthorized access to the Service, other accounts, or related systems.
  • Interfere with or disrupt the Service or servers connected to the Service.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use automated tools (bots, scrapers) to access the Service without our written consent.
  • Resell, sublicense, or redistribute the Service without our authorization.
  • Upload malicious code, viruses, or harmful content to the Service.

7. Intellectual Property

The Service, including its design, features, algorithms, documentation, and branding, is the intellectual property of Capalux and is protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works based on the Service without our prior written consent.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible).
  • Emergency maintenance or security updates.
  • Factors beyond our reasonable control (force majeure).

9. Limitation of Liability

To the maximum extent permitted by applicable law, Capalux and its officers, directors, employees, and agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, data, use, or goodwill arising from the use of the Service.
  • Scheduling conflicts or errors resulting from the generated timetables.
  • Any damages exceeding the amount you paid for the Service in the preceding 12 months.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Indemnification

You agree to indemnify, defend, and hold harmless Capalux and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

11. Termination

Either party may terminate the agreement at any time. You may cancel your subscription and delete your account through the Service settings. We may suspend or terminate your access if you violate these Terms, with or without notice.

Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination, after which it will be permanently deleted unless retention is required by law.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Capalux is registered, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
